General Terms and Conditions
General Terms and Conditions (GTC) of Bodyzone GmbH, Basel (hereinafter "Bodyzone") for online voucher purchases, online product purchases and online treatment reservations via
www.bodyzone.ch or https://shop.bodyzone.ch
(hereinafter "online shop")
A: General
- The data entered for online orders are recorded electronically without credit card details in our system. They will be kept confidential and not disclosed to third parties.
- Purchases in the online shop are only possible with prepayment by credit card. Any refunds will be made by crediting the credit card used for payment via the payment processing service provider.
- Bodyzone can change the general terms and conditions unilaterally at any time. The general terms and conditions applicable at the time of the order apply.
- Bodyzone reserves the right to change the prices of the products and services offered at any time. The price in the online shop at the time of the order is decisive for the conclusion of the purchase contract.
- Swiss law applies. The place of jurisdiction is Basel.
B: Gift vouchers
- The vouchers can either be printed out yourself or ordered for dispatch by Bodyzone. Every voucher has a number that is registered in our system. The voucher will be accepted as payment at Bodyzone based on the number and there is no obligation for Bodyzone to check whether the redeeming person is the legal owner of the voucher. After a voucher has been redeemed, the redemption of further vouchers with the same number is excluded.
- There is no right of withdrawal for vouchers ordered and paid for online. A return against cash payment is excluded.
- The period of validity of the vouchers is not limited.
- A voucher can only be redeemed for the corresponding treatment by Bodyzone or, in the case of a value voucher, for a treatment at a price of the value of the voucher. If the value of the voucher is higher than the treatment provided by Bodyzone, a refund of the difference in cash is excluded, but a voucher for the remaining difference will be issued.
C: Treatment reservations
- Treatments and spa packages can be reserved online and must be prepaid by credit card. The prices include the legal value added tax.
- Appointment cancellations are possible up to 24 hours before the booked appointment and the amount paid will be refunded to the credit card used for payment via the payment service provider.
- In case of cancellation of appointments later than 24 hours in advance and in case of no-show for a reserved treatment, the prepaid amount is forfeited without compensation.
- If you arrive late, the treatment time will be shortened accordingly without entitlement to a price reduction.
D: Product purchases
- All prices published in the online shop are end prices including the legal value added tax.
- For each order an additional shipping will be added independent of the order size which will be shown in the shopping cart.
- We take great care to provide all information about availability and delivery time correctly, however shortages may occur, therefore all indications are without guarantee and can change at any time.
- Pictures and Drawings of products in advertisements, web postings, brochures and in the onlineshop are for illustration purposes and are without any guarantee for accuracy.
- The receipt of an online order is confirmed to the customer with an automatically generated order confirmation with an attached invoice to the email address entered with the order. The receipt of the automatically generated order confirmation does not contain a promise that the product can actually be delivered. It merely indicates to the customer that the order has been received by the online shop and that the purchase contract has been concluded without withdrawal rights under the condition that the product can be delivered.
- The product will be shipped without further notice by mail to the delivery address indicated in the online order when the order was placed. Delivery is only possible to Swiss addresses. Collection at our premises of products ordered online is not possible. With the dispatch, Bodyzone has fulfilled its performance obligation by the purchase contract. Bodyzone assumes no liability or further performance obligations in case of undeliverability.
- If a delivery is not possible within 14 days on the part of Bodyzone, the price paid including shipping costs will be refunded by Bodyzone to the customer. Further claims of the customer do not exist.
- If a purchased product has a defect or if the customer has a complaint, he/she will inform Bodyzone about the defect or complaint by email to info@bodyzone.ch and return the defective products. In case of justified complaints or actual product defects Bodyzone will refund the paid purchase price including the paid shipping costs.
